Human rights activist and politician, Omoyele Sowore, will remain in custody at the Kuje Correctional Centre until June 30.
when the Federal High Court in Abuja is expected to rule on his application seeking to overturn the bench warrant issued for his arrest and the revocation of his bail.
At Wednesday’s proceedings, Raphael Adakole, who appeared for Senior Advocate of Nigeria (SAN) Adeyinka Fusika, urged the court to set aside its June 16 order revoking Sowore’s bail following his absence in court on the scheduled trial date.
The defence also asked the court to withdraw the bench warrant issued against him and reinstate the bail earlier granted.
However, prosecuting counsel, Akinlolu Kehinde SAN, opposed the application, arguing that the defendant had not provided sufficient and credible facts to warrant the court’s favourable consideration.
The defence further sought Sowore’s temporary release into the custody of his legal team pending the ruling, citing concerns about his health and assuring the court of his readiness to attend subsequent proceedings.
In his response, Justice Muhammad Umar said he needed more time to review the affidavits and counter-affidavits filed by both parties before taking a decision.
The judge held that granting the request for Sowore’s temporary release could amount to deciding the substantive application before delivering a ruling. He subsequently declined the request and adjourned the matter till June 30 for ruling.
